US SEC’s analysis on security-based swaps large position reporting is mostly good news for the SEC and for hedge funds

The US Securities and Exchange Commission (SEC) recently re-opened the comment period for its Position Reporting of Large Security-Based Swap Positions (10B-1) proposal, and released a memorandum from the Division of Economic and Risk Analysis of what the impact might be. We see both actions in a positive light for hedge funds who have expressed concern about what transparency the proposal may reveal and for the SEC’s justification for the initial action.
