While US industry associations have pointed out the risks of regulatory overreach on liquidity and systemic risk for some time, regulators themselves are now starting to voice concerns. They are right to do so: previous experience has shown that gold plated bank regulation has an adverse effect on market liquidity, which regulators must work to preserve for the benefit of the real economy. We haven’t yet seen a way to accomplish both goals at the same time.
